Before the Court is Plaintiff's Motion to Amend the Court's Order dated November 18, 2002, granting Defendants' Motion for Summary Judgment (Docket #34). For the reasons discussed below, the Court GRANTS Plaintiff's motion. Section III(C) of the November 18 Order misstates the status of the counts before the Court by failing to acknowledge the parties' prior joint dismissal of Count VII filed on September 10, 2002. As such, the Court's Order currently reads as though counsel for Plaintiff failed to address a "live" issue involved in the Defendants' Motion for Summary Judgment. To correct the misstatement, the Court hereby AMENDS the Order granting Defendants' Motion for Summary Judgment to reflect the prior joint dismissal of Count VII and STRIKES Section III(C) of the Court's Order. SO ORDERED.
