The government filed a motion to dismiss, pursuant to Fed.R.Civ.P. 12(b)(6), on June 21, 2002, and the plaintiff's attorney indicated that he would research the issue and file a response. On December 4, 2002, Plaintiff's attorney informed the Court that plaintiff does not oppose the government's motion to dismiss.
