DONALD RAILSBACK, Plaintiff, v. THE COLUMBIAN NEWSPAPER, a Washington Corporation, et al., Defendant.

ORDER GRANTING DEFENDANTS' MOTION TO DISMISS

FRANKLIN D. BURGESS, United States District Judge

This matter comes before the Court on the Motion to Dismiss filed by Defendants The Columbian Publishing Company and Stephanie Thomson along with Robert L. Harris pursuant to Federal Rule of Civil Procedure 12(b)(1). Plaintiff Donald Railsback's ("Mr. Railsback"), however, has failed to file a response to Defendants' motion as required by Western District of Washington Local Civil Rule 7(b)(2). Accordingly, the Court, in its discretion, deems Mr. Railsback's failure to be an admission that any opposition to Defendants' motion is without merit. See Local Civil Rule 7(b)(4).

ACCORDINGLY,

IT IS SO ORDERED:

(1) Defendants' Motion to Dismiss (Dkt. #6) should be GRANTED; and

(2) The Clerk is directed send copies of this Order to Mr. Railsback at his last known address and to counsel for Defendants.
