ORDER OF DISMISSAL

Before the Court is plaintiffs' Notice of Voluntary Dismissal (Dkt. 8). Since neither an answer nor a motion for summary judgment has been filed by the defendant, the Federal Rules of Civil Procedure permit such voluntary dismissal by plaintiffs. See Fed.R.Civ.P. 41(a)(1). Accordingly, it is
ORDERED that this action is hereby DISMISSED without prejudice. All pending motions are DENIED as moot, and the Clerk is directed to close this file.
