WM. TERRELL HODGES, Senior District Judge
This action was initiated by a taxpayer acting pro se who brings claims against two individual agents of the Internal Revenue Service. Although the Plaintiff's Complaint purports to state a "Counterclaim in admiralty" and assert "God-given unalienable rights in the original real estate," the Plaintiff's claims amount to a dispute regarding an administrative hold placed on his bank accounts by the Internal Revenue Service.
The United States Magistrate Judge has issued two reports recommending, respectively, that Defendant Lowder's motion to dismiss Plaintiff Ray's counterclaim in admiralty with prejudice (Doc. 5) be GRANTED, that the Plaintiff's claims against Defendant Lowder be dismissed with prejudice, and that Defendant Wenzel's motion to dismiss (Doc. 8) be GRANTED. Aside from attempting to return copies of the Reports and Recommendations to the Clerk of this Court with the notation "Refused for Cause," the Plaintiff has not objected to the report and recommendations of the Magistrate Judge, and the time for objecting has elapsed.
See Order of Magistrate Judge (Doc. 13).
Meanwhile, Defendant Lowder has filed a motion to quash and enjoin the Plaintiff from filing and recording further false pleadings (Doc. 11). Offering exhibits in support of his motion, Lowder contends that the Plaintiff has been filing sham documents in the public records of Lake County, Florida which purport to be Notices of Entry of Judgment and Default Judgments obtained in this Court.
Upon an independent examination of the file and upon due consideration, it is ordered that:
(1) the reports and recommendations of the Magistrate Judge (Docs. 7 and 10) are adopted, confirmed and made a part hereof;
(2) Defendant Lowder's motion to dismiss the Plaintiff's Complaint with prejudice (Doc. 5) is GRANTED, but Lowder's claim for attorney fees and costs is DENIED;
(3) Defendant Wenzel's motion to dismiss the Plaintiff's claims with prejudice (Doc. 8) is GRANTED;
(4) the Clerk is DIRECTED to withhold the entry of judgment pending resolution of Defendant Lowder's Motion to Quash and Enjoin Ray from Filing and Recording Further False Pleadings against Lowder and/or Colonial Bank, its Employees, Subsidiaries, or Affiliates (Doc. 11), which is hereby referred to the United States Magistrate Judge to conduct such proceedings, if any, as he deems necessary to the making of a report and recommendation on the matter.
IT IS SO ORDERED.
