GARR M. KING, District Judge
The hearing on the Petition To Enforce Internal Revenue Service ("IRS") Summons filed by the United Sates was held before this Court on March 31, 2003, at 3:30 p.m. The United States was represented at the hearing by United States Department of Justice Trial Attorney Jeremy Hendon. Respondent, Donna Miller, personally appeared and stated that she is willing to fully comply with the IRS summons.
After review of the pleadings filed by the United States and respondent's statements at the hearing, and based upon the Court's oral ruling at the hearing, which is incorporated herein by reference, IT IS ORDERED that respondent, Donna Miller, provide the information sought by the IRS in its summons issued on October 11, 2002 (Exhibit B to Petition), with the exception of employment information returns, Form W-2, Form W-3, Form 1099, and Form 1096 for tax years 1997, 1998, 1999, 2000, and 2001 which are already in the possession of the IRS. Respondent has shown no reason why the summonses should not be enforced and it is apparent from the petition that the United States has met the requirements for enforcement of the summons as required by United States v. Powell. Respondent is to comply with the summons by April 18, 2003, by mailing copies of the responsive documents to: Internal Revenue Service, Mail Stop 3108, ATTN: Dennis Brown, Revenue Agent, 4330 North Highlands, California 95660. If respondent does not comply as ordered herein, she will be subject to being held in contempt of court.
