STATE OF TEXAS, Nominal Plaintiff, Respondent v. ANN WHITLOW CLARK, Defendant, Petitioner

ORDER

JORGE SOLIS, District Judge

On May 27, 2003, this Court denied Petitioner's Motion for Extension of Time to File Notice of Appeal on grounds that she did not file her motion in a timely manner. Petitioner now moves this Court to reconsider that decision on grounds that a timely filed motion was returned to her by the Clerk of the Court. The only evidence in support of her claim is a copy of a letter purportedly submitted along with her Motion for Extension of Time to File Notice of Appeal, in which Ms. Clark states that her initial submission was returned to her in its entirety, unfiled. Petitioner provides no evidence corroborating this hearsay. No other grounds for granting the motion are apparent from the Motion to Reconsider. The Motion is DENIED.

It is so ordered.
