Gloria Jean Jones, Plaintiff, v. Norman Y. Mineta, Secretary, Department of Transportation, Federal A

MEMORANDUM ORDER

JOHN LUNGSTRUM, Chief District Judge

On May 15, 2003, this court issued an order advising plaintiff that proper service had not been made in this case and further advising plaintiff that her complaint would be dismissed unless she effected proper service on or before June 9, 2003. A review of the clerk's docket regarding this case reveals that plaintiff has not complied with the court's May 15, 2003 order. Specifically, plaintiff has still not made proof of service on the Secretary of Transportation by attaching the green certified mail receipt to the back side of the second summons and then filing such summons with the clerk. Moreover, while the docket reveals that a summons was issued to the United States Attorney General, see Fed.R.Civ.P. 4(i), proof of service was never made concerning this entity. Plaintiff's complaint, therefore, is dismissed without prejudice.

IT IS SO ORDERED.
