JAY C. ZAINEY, Senior District Judge
This matter is before the Court on the motion of all claimants found on Exhibit List "P" to enforce settlement. (Rec. Doc. 109). The motion is opposed by M/V Westchester interests. For the reasons that follow, the motion is DENIED.
BACKGROUND
The M/V WESTCHESTER allegedly lost power and struck an underwater obstruction on November 28, 2000 in Plaquemines Parish, Louisiana, causing crude oil cargo to escape into the Mississippi River. Subsequently, the WESTCHESTER filed this limitation proceeding. Master answer and claim forms were submitted by Claimants-in-Limitation and contained the names of approximately 4000 claimants represented by the Committee attorneys and approximately 2000 claimants represented by attorney Michael Fenasci.
DISCUSSION
The instant dispute concerns an alleged settlement agreement reached between the "Exhibit P" claimants and the vessel interests. Attorney Fenasci alleges that the defendants have failed to pay medical bills and settlement proceeds relative to the Exhibit P claimants.
The Westchester interests do not deny that they agreed to settle the claims of those individuals listed on Exhibit P. These individuals are former clients of the Committee who elected to terminate the attorney client relationship with the committee and offered to settle their cases through Mr. Fenasci. In addition to executed releases, Mr. Fenasci produced letters of termination of. the attorney client relationship to the Westchester interests. With Mr. Fenasci's agreement, one-third of the gross settlement figure was withheld as representing attorneys' fees and those funds remain in an escrow account pending the determination of whether Mr. Fenasci or the Committee attorneys are entitled to the fees. The balance (net proceeds) was paid to the individual settling claimants.
The Westchester interests stand ready to pay and have in fact paid numerous claims that were properly documented. The Westchester interests further allege that the settlement of these claims was exclusive of medical expenses. Further, the Westchester interests have not been provided with copies of any medical invoices that would be paid directly to the medical providers.
Once again, Mr. Fenasci attempts to embroil this Court in a fee dispute between him and the Committee attorneys. This request to enforce settlement is in fact a fee dispute. This Court again declines to be brought in to determine this issue whether it be under the guise of a motion to distribute attorneys####1 fees or a motion to enforce settlement.
Accordingly,
IT IS ORDERED that the Motion to Enforce Settlement is DENIED. IT IS FURTHER ORDERED that Mr. Fenasci shall provide the Westchester interests a specific list of all claimants listed on Exhibit P who have not received their settlement proceeds under the terms of the settlement agreement.
