ARMANDO PERAZA SALAZAR, Petitioner, v. GEORGE GALAZA, Respondent

JUDGMENT

WILLIAM HASKELL ALSUP, District Judge

For the reasons stated in the Court's order dated October 20, 2003, denying the petition for writ of habeas corpus, JUDGMENT is HEREBY ENTERED in favor of respondent, with the exception of petitioner's claim that the jury was improperly instructed because under California law, "duress" cannot be proven by "hardship." As to that claim, the parties are to notify the Court once the California Supreme Court rules in People v. Edmonton, 63 P.3d 217 (Cal. Jan. 22, 2003) (review granted). The Clerk of the Court SHALL CLOSE THE FILE.

IT IS SO ORDERED.
