IN RE: PHENYLPROPANOLAMINE (PPA) PRODUCTS LIABILITY LITIGATION, This document relates to: Donna Sasseen v. IDE Interstate, et al.

ORDER REGARDING FAILURE TO USE CASE MANAGEMENT/ELECTRONIC CASE FILING SYSTEM

BARBARA ROTHSTEIN, District Judge

On November 28, 2003, Defendant Novartis Consumer Health, Inc. attempted to file its Answer to Plaintiff's Second Amended Complaint with the Court. This filing is in violation of the Court's October 30, 2003 Order Regarding Use of Case Management/Electronic Case Filing System ("CM/ECF"). The October 30, 2003 Order required all represented parties in MDL 1407 to utilize CM/ECF as of November 15, 2003 and provided that an attorney who is not an electronic filing user by November 15, 2003, must show good cause to file and serve pleadings and other papers in the traditional manner. The Order further provided that counsel who succeed in showing cause will nevertheless be required to include with traditionally filed papers a disk or CD-ROM containing a portable document format ("PDF") copy of all papers filed with the Court.

The filing in the above case is in violation of the Court's October 30, 2003 Order because counsel failed to (1) file a motion showing good cause to file pleadings in the traditional manner, and (2) provide the Court with a PDF copy of the filing. The Court hereby rejects this attempt to file Defendant Novartis Consumer Health, Inc.'s Answer to Plaintiff's Second Amended Complaint. Counsel is instructed to refile electronically or according to the provisions of the October 30, 2003 Order.
