McGILL TECHNOLOGY LIMITED, Plaintiff, v. GOURMET TECHNOLOGIES, INC., ALLIED BRANDS INTERNATIONAL, INC., and NEW BRUNSWICK SAW SERVICE, INC., Defendants

ORDER TO SHOW CAUSE

PAUL GADOLA, Senior District Judge

With respect to Defendant Gourmet Technologies and Defendant Allied Brands International, the Court has dismissed this civil action without prejudice for lack of personal jurisdiction. See Fed.R.Civ.P. 12(b)(2). Consequently, Defendant New Brunswick Saw Service ("NBSS") is the only defendant remaining in this action. On September 5, 2003, Plaintiff requested an entry of default against Defendant NBSS, and the Clerk of the Court's entry of default against Defendant NBSS was issued on September 8, 2003. See Fed.R.Civ.P. 55(a). Since Plaintiff obtained this entry of default, Plaintiff has not taken any additional steps in this Court to prosecute this action against Defendant NBSS.

ACCORDINGLY, IT IS HEREBY ORDERED that, within ELEVEN (11) DAYS of the filing of this order, Plaintiff shall SHOW CAUSE IN WRITING why this civil action against Defendant NBSS should not. be dismissed for failure to prosecute. See Link v. Wabash R.R. Co., 370 U.S. 626, 630-33 (1962); E.D. Mich. LR 41.2.

SO ORDERED.
