THIS MATTER having been brought before the Court upon Defendant, Philip Morris, USA, Inc.'s Objections to Magistrate Judge Hedges' October 31, 2003 Report Recommendation to remand this matter to the Hudson County Superior Court, from where it was removed; and this Court having read, and considered the parties' moving papers; and for reasons stated in the accompanying Opinion;
IT IS on this 13th day of, February 2004,
ORDERED that Plaintiffs, Sidney Stern, Theresa Stern, and Nick Commisso, on behalf of themselves and others similarly situated, ("Plaintiffs") motion to remand the above-captioned matter to the New Jersey Superior Court, Middlesex County is GRANTED; and it is further
ORDERED that the above-entitled action be and hereby expeditiously remanded to the New Jersey Superior Court, Middlesex County, from where it was removed.
