Desnick, et al., Counterclaim and Cross-Claim Defendants and Nomura Asset Capital Corporation, et al., Third Party Defendants ORDER CAROL DOYLE, Bankruptcy Judge For the reasons set forth in the Memorandum Opinion entered February 26, 2004, on the three motions presently before the court: Doctors Hospital's motion to dismiss the counter-claim and cross-claim complaint of defendant LaSalle Bank as Trustee; cross-claim defendants' motion to dismiss LaSalle's cross-claim; and Nomura Asset Capital Corporation ("Nomura") and Asset Securitization Corporation's ("ASC") motion to dismiss, or, alternatively, transfer, abstain, or stay the third party complaint of LaSalle Bank National Association, the motions to dismiss are granted, All of LaSalle's counter-claims against Doctors Hospital are dismissed except for the claim for breach of guaranty against DH. All of LaSalle's cross-claims are dismissed. LaSalle's third party complaint against Nomura and ASC is dismissed, Nomura and ASC's motion to transfer is denied.
