This 1st day of March 2004, it appears to the Court that appellee filed a motion to dismiss this appeal on the ground that appellant failed to file her opening brief as required by the Court's rules. The Clerk of the Court also issued a notice to appellant to show cause why the appeal should not be dismissed for her failure to diligently prosecute her appeal. Appellant has not responded to either the motion to dismiss or the notice to show cause. Dismissal of this action, therefore, is deemed to be unopposed.
