4. The petitioners are directed to conclude matters incident to the Petition for Distribution of the Settlement Proceeds herein as soon as possible and to thereafter promptly submit to this Court a Supplemental Petition detailing the proposed distribution of the settlement proceeds remaining after attorney's fees and expenses, and providing for reimbursement of the subrogation claims of the State of Minnesota, Department of Human Services and the ERISA carrier for Edward Don Company.
MEMORANDUM
The Court calculated attorney's fees as follows:
1. $11,099,750 less ERISA subrogation interests ($600,000), balance $10,499,750.
2. Less State of Minnesota subrogation interest ($220,696.13), balance $10,279,053.87, divided by one third equals $3,426,351.29.
The Court finds that said attorney's fees are reasonable and further that it provides a full and adequate reimbursement for the attorney's expenses in this matter. A copy of the attorney's retainer agreement has been provided to the Court and shall be filed contemporaneously with the Clerk of Court and ordered sealed.
