WILLIAM THOMPSON, Appellant(s) v. STATE OF FLORIDA, Appellee(s).

Having reviewed the pleadings and record in this case, we hereby GRANT the State's "Motion to Dismiss" Appellant William Thompson's appeal of an August 5, 2003, trial court order striking his rule 3.851 amended motion to vacate judgment and sentence. This order is entered without prejudice. On remand, Thompson shall have thirty (30) days from the date of entry of this order to re-file an amended motion to vacate judgment and sentence that complies with the page limitation of rule 3.851.

Furthermore, we treat Thompson's appeal of a September 4, 2003, trial court order denying his motion for disqualification as a petition for writ of prohibition. See Fla. R. App. P. 9.040(c). As such, we DENY the petition on the merits.

It is so ordered.

ANSTEAD, C.J., and WELLS, PARIENTE, LEWIS, QUINCE, CANTERO and BELL, JJ., concur.
