The "Motion to Strike Affidavit of Kenneth J. Domilise" filed by Water Quality Insurance Syndicate (Doc. #99). A "Motion for Summary Judgment Pursuant to Federal Rule of Civil Procedure Rule 56" filed by Taira Lynn Marine Inc. (Doc. #105). The "Motion to Dismiss for Failure to State a Claim, or Alternatively, to Enforce Injunction Order" filed by Water Quality Insurance Syndicate (Doc. #6 in Civil Action No. 6:02CV00189). The Court heard oral argument pertaining to these motions on June 13, 2002. The Court denied all of these motions in open court and then rescinded its ruling and took the motions under advisement. After hearing oral argument by the parties, examining all of the voluminous filings and thoroughly reviewing all oppositions and reply briefs, the Court hereby DENIES all of the pending motions at this time. Accordingly, Documents #99 and #105 in Civil Action 01-CV-1420 are DENIED and Document #6 in Civil Action 02-CV-00189 is DENIED.
