Come now Bridge Information Systems Inc., et. al, through Scott P. Peltz, as Chapter 11 Plan Administrator for BIS Administration, Inc. f/k/a Bridge Information Systems, Inc., et. al. ("Debtors") and GE Capital Corporation d/b/a EKCC a/d/b/a Danka Office Imaging Company ("GE"), by and through the undersigned counsel and states as follows:
1. This Court has jurisdiction over this objection pursuant to 28 U.S.C. §§ 157 and 1334, 11 U.S.C. § 502, Rule 3007 of the FEDERAL RULES OF BANKRUPTCY PROCEDURE, and Rule 9.01(B) of the LOCAL RULES OF THE UNITED STATES DISTRICT COURT FOR THE EASTERN DISTRICT OF MISSOURI, and the confirmed Plan of Debtors.
2. Venue is proper in this Court pursuant to 28 U.S.C. § 1409. This matter is a core proceeding pursuant to 28 U.S.C. §§ 157(b)(2)(A), (B), and (O).
3. On or about May 25, 2002, Claimant GE filed its Motion for Allowance of Administrative Expense Claim of GE Capital Corporation, Inc., which has been assigned Claim No. 1370, in the amount of $63,973.19 (the "Claim").
4. On or about August 5, 2003, Debtors filed their Omnibus Objection to Claims in which Debtors alleged several bases under which the Claim should be disallowed (the "Objection").
5. Debtors and GE, in settlement of the Objection an the Claim, agree as follows: (i) the Objection will be sustained in part and overruled in part; (ii) GE shall hold an allowed administrative priority claim in case 01-41593-293 in the amount of $13,500.00; and (iii) GE shall hold an allowed unsecured, nonpriority claim in case 01-41593-293 in the amount of $7,926.98.
