MICHAEL WASHINGTON, Petitioner, v. DOUGLAS DRETKE, Director, Texas Department of Criminal Justice, Correctional Institutions Di

ORDER OVERRULING OBJECTIONS, ADOPTING REPORT AND RECOMMENDATION, and DENYING PETITION FOR A WRIT OF HABEAS CORPUS

MARY ROBINSON, District Judge

Petitioner MICHAEL WASHINGTON has filed a petition for a writ of habeas corpus challenging the result of a state prison disciplinary proceeding. On August 12, 2004, the United States Magistrate Judge issued a Report and Recommendation in this cause, recommending therein that petitioner's habeas application be denied because petitioner is not eligible for mandatory supervised release and did not lose previously accrued good time credits. Petitioner filed objections to the Report and Recommendation on August 24, 2004.

The undersigned United States District Judge has made an independent examination of the record in this case. Petitioner's objections are without merit and are hereby OVERRULED. The Magistrate Judge's Report and Recommendation is hereby ADOPTED. Accordingly, the petition for a writ of habeas corpus filed by petitioner is DENIED.

IT IS SO ORDERED.

JUDGMENT

Of equal date herewith, the undersigned United States District Judge has entered an Order denying petitioner's application for a writ of habeas corpus.

JUDGMENT IS ENTERED ACCORDINGLY.
