DAVID BERNTHAL, Magistrate Judge
Before the Court is Plaintiff SEC's Motion to Amend the Final Judgment as to Paul J. House, III (#110). The Court previously entered a final judgment against Defendant House. In its written order, the Court intentionally omitted the following language contained in Plaintiff's proposed order, "Defendant House shall satisfy this obligation by paying $3,268,087 within ten business days to the Clerk of this Court, together with a cover letter identifying Paul J. House, III as a defendant in this action; setting forth the title and civil action number of this action and the name of this Court; specifying that payment is made pursuant to this Final Judgment." While the Court did have sufficient information before it to determine the proper amount of the judgment, it certainly did not, nor does it now, have sufficient information before it to order a timetable for payment. Rarely, if ever, has the Court seen an order directing entry of judgment that contained a deadline for payment.
Should the Court grant the present motion and impose a deadline, Defendant House would be subject to contempt proceedings should he fail to pay in a timely fashion. However, the Court cannot find someone in contempt if they lack the ability to comply with the order. Therefore, the relief sought is not justified. Plaintiff's counsel, like other skilled counsel regularly appearing before the Court, are free to pursue the various means available for satisfaction of judgment. Arbitrarily picking a deadline for payment without any meaningful information before it is not a proper way to proceed. Accordingly, the motion to amend (#110) is DENIED.
