Came on for consideration Disbursing Agent's Motion For Court To Abstain From Deciding And Also To Continue Merits Hearing On Disbursing Agent's Objection To Proof Of Claim Filed By SSW, Inc. Pending Outcome Of State Court Litigation (Docket No. 5176) (the "Motion") asking the Court to abstain from deciding the merits of the Disbursing Agent's Objection to Proof of Claim Filed by SSW, Inc. (Docket No. 3940) pending the resolution of the State Court Litigation (as defined in the Motion) and to continue any merits hearing on that objection until the State Court Litigation has been decided. The Court finds, evidenced by counsels' signatures below, that the parties are in agreement that the request should be granted. Accordingly, it is hereby:
ORDERED that the Motion is GRANTED; it is further
ORDERED that the hearing on the merits of the Disbursing Agent's Objection to Proof of Claim Filed by SSW, Inc. (Docket No. 3940) is stayed until the resolution of the State Court Litigation. ORDERED that upon resolution of the State Court Litigation, the parties are directed to file with this Court a Status Report and request for action by this Court in order to resolve the Objection to Proof of Claim (Docket No. 3940).
