UNITED STATES OF AMERICA, v. ERIC ROBERT RUDOLPH, Defendant.

ORDER RESETTING HEARING

TERRY PUTNAM, Magistrate Judge

The court previously set defendant's motion to compel (doc. 384) and second motion for production of laboratory bench notes (doc. 385) for hearing on December 9, 2004, both of which were filed on November 22, 2004. The court did so utilizing the electronic case filing system on November 29, 2004. The court is now informed that none of defense counsel received notice of the setting, and they have now asked for postponement. Having consulted with both sides by telephone, the motion to continue the hearing on the motions is GRANTED, and the motions are RESET for hearing on December 15, 2004, at 9:00 a.m., in Courtroom 2A, Hugo L. Black U.S. Courthouse, Birmingham, Alabama. The defendant shall be present, unless he waives his presence at the hearing in writing.

The Clerk is DIRECTED to forward a copy of the foregoing to all counsel of record.
