It is therefore ORDERED, ADJUDGED, and DECREED that Plaintiff's Complaint is dismissed with prejudice as frivolous pursuant to 28 U.S.C. §§ 1915(e)(2)(B), 1915A(a), and 1915A(b)(1). It is further ORDERED that the clerk of this court shall transmit a copy of this judgment and a copy of the court's order of December 28, 2004 accepting the Findings, Conclusions and Recommendation of the United States Magistrate Judge to all parties.
