JAMES O. BROWNING, District Judge
THIS MATTER comes before the Court on the Defendants' Motion in Limine to Exclude Confidential Evidence and Future Damage Calculations, filed October 19, 2004 (Doc. 50). The Court held a hearing on this matter on December 3, 2004. Consistent with the Court's ruling at the hearing on this motion, and for the reasons given at the time of the hearing, the Court will deny the Defendants' motion.
The Court's ruling on evidence about the mediation is premised on the Plaintiff's representation on what she intends to introduce. If she goes beyond that evidence, the Defendants may approach the Court about the admissibility of other evidence of the mediation. The Plaintiff shall not seek to introduce evidence of what the parties or the mediator said at the mediation.
As to the evidence of future damages, the Plaintiff has not indicated whether she will testify about present value. The Court will thus not rule at this time whether she can testifying about present value.
IT IS ORDERED that the Defendants' Motion in Limine to Exclude Confidential Evidence and Future Damage Calculations is denied.
