THIS MATTER having been brought before the Court upon motion by Stephen B. Nolan, Esquire, attorney for Plaintiff and Counterclaim Defendant Koch Materials, Inc., for an Order granting partial summary judgment; and the Court having considered the moving papers, and the opposition thereto; and for the reasons expressed in the Opinion issued this date;
IT IS HEREBY ORDERED that Koch's motion be GRANTED IN PART AND DENIED IN PART; and
IT IS FURTHER ORDERED that judgment be entered in favor of Koch and against Defendant and Counterclaim Plaintiff Shore Slurry Seal, Inc. on Counts IV and V of the Amended Counterclaim; and
IT IS FURTHER ORDERED that judgment be entered in favor of Koch and against Shore Slurry Seal only on that part of Count VII that states a claim pertaining to the Settlement Agreement; and
IT IS FURTHER ORDERED that summary judgment be denied in all other respects.
