IN RE: WALTER D. MacKAY, CHAPTER SEVEN, DEBTOR.

ORDER

JOHN THOMAS, Bankruptcy Judge

For those reasons indicated in the Opinion filed this date, IT IS HEREBY ORDERED that the request of Debtor's counsel for approval of the fees and cost represented in the initial fee application filed on January 29, 2003 are approved in so far as the fees and costs survive scrutiny under 11 U.S.C. § 329(a) since they are found reasonable and necessary, except those fees and/or costs specifically denied in the Opinion. Counsel's request that these fees and costs be paid by the Chapter 7 estate and be treated as administrative expenses enjoying priority of payment from the Trustee is denied; and IT IS FURTHER ORDERED that the request for fees and costs represented by the fee application filed on January 7, 2004 is approved as reasonable and necessary to the debtor exclusive of the fees/costs specifically denied by the Opinion. The request to have the approved fees and costs paid from the estate as administrative expenses enjoying priority of payment as referenced by 11 U.S.C. § 726(b) is granted.
