The Debtor's Motion for Order Amending Scheduling Order Dated January 26, 2005 came on for hearing on February 7, 2005 at 1:30 p.m. Appearances were as noted in the record. Upon consideration of the motion and all papers and argument submitted in connection with the motion, the Court rules as follows:
1. In light of the parties' agreement to a thirty-day standstill of this case, the Court finds good cause to modify in the following respects its scheduling order of January 26, 2005 (entitled Order Granting Motion To Increase the Number of Allowed Interrogatories and Depositions, Set Expedited Discovery Dates, and Set Case Management Procedures (Docket No. 103-1), hereafter, "CMO No. 1"). CMO No. 1 shall continue to govern except as specifically modified herein.
2. Except as provided herein, from and including January 31, 2005 through February 28, 2005 (the "Standstill Period"), there shall be no: (i) discovery initiated or completed; (ii) pleadings, motions, responses, memoranda or briefs served or filed; or (iii) hearings scheduled. All outstanding time limits for currently pending pleadings and motions are tolled. Nothing in this paragraph precludes the Debtor from filing reports, filing pleadings or taking other actions to continue the Chapter 11 case which are not related to the controversies between the Plan Proponents and insurers. In the event that any filing is made during the Standstill Period, any insurer objecting to the filing or the scope of the relief sought may file a "Notice of Objection" setting forth the reasons for its objection and requesting that the hearing of any such filing or request be continued on the Court's calendar to the first available date that is after the expiration of the Standstill Period.
3. Great American Insurance Company has filed a motion to transfer proceedings to the District Court. The February 10, 2005 hearing on this motion is taken off calendar, and the hearing is rescheduled for March 23, 2005 at 10:00 a.m. All response, opposition, reply or joinder motions or memoranda respecting this motion shall be filed by March 10, 2005; provided, however, that no such papers are required to be filed or served within the Standstill Period.
4. CNA has filed an adversary complaint against Debtor and others. No response, answer, reply or joinder motions or memoranda respecting this complaint are required to be filed or served within the Standstill Period. All parties will have at least 10 days following termination of the Standstill Period to respond to this complaint.
5. Section I of CMO No. 1 (Fact Discovery) is amended in the following respects:
a. Regarding paragraph I.A.2 of CMO No. 1, Plan Proponents shall serve by March 2, 2005 their written responses and objections to any written discovery that was served on them before entry of this order (to the extent they have not already served such responses and objections).
b. The deadline for Plan Proponents to complete their initial document production, set forth in paragraph I.A.3 of CMO No. 1, is extended to March 2, 2005.
c. The deadline for Plan Proponents to submit a list of witnesses and general description of their testimony, set forth in paragraph I.A.4 of CMO No. 1, is extended to March 2, 2005.
d. The first date on which depositions of Plan Proponents' fact witnesses may commence, set forth in paragraph I.A.5 of CMO No. 1, is extended to March 2, 2005.
e. The deadline for Objecting Parties to submit a list of witnesses and general description of their testimony, set forth in paragraph I.B.8 of CMO No. 1, is extended to March 9, 2005, with a right to supplement through March 16, 2005.
6. Section II of CMO No. 1 (Expert Discovery) is deleted in its entirety and the following is substituted in its place: A schedule for expert discovery shall be prepared and implemented after the Court rules on all issues presented at the Legal Issues Hearing.
7. Section III of CMO No. 1 (Pre-Trial Motion Practice) is not amended, except with respect to Exhibit "A" referenced therein. Attached hereto is an amended Exhibit A.
8. Section IV of CMO No. 1 (Other Deadlines) is amended as follows:
a. The date for the Legal Issues Hearing, set forth in paragraph IV.19 of CMO No. 1, is continued to March 30, 2005.
b. The following briefing schedule with respect to the Legal Issues Hearing shall replace that set forth in paragraph IV.19 of CMO No. 1:
i. The deadline for Plan Proponents to file and serve a statement of legal issues is extended to March 2, 2005;
ii. The deadline for all Parties to file and serve their opening briefs is extended to March 9, 2005;
iii. The deadline for all Parties to file and serve their opposition briefs is extended to March 18, 2005; and
iv. The deadline for all Parties to file and serve their reply briefs is extended to March 24, 2005.
9. Except as specifically modified herein, CMO No. 1 shall continue in full force and effect.
