ROBERT HAYES SCOTT, Magistrate Judge
This matter having come before the Court on Defendant's Motion to Enforce Order Granting Motion to Compel [docket no. 68] and the Court having considered said motion (there has been no response filed thereto by Plaintiff) together with all the pleadings in the above captioned cause and being otherwise fully advised in the premises;
IT IS THEREFORE ORDERED that Defendant's Motion to Enforce Order Granting Motion to Compel [docket no. 68] is hereby granted. On January 10, 2005, the Court entered its order granting Defendant's Motion to Compel and ordering the Plaintiff to supplement and/or answer interrogatory nos. 1, 3, 5, 8, 13, 15, 17, 18, and 19 and to respond to request for production nos. 7, 16, 18, 19, 20, and 21. The Court further ordered that the interrogatories and requests for production be supplemented on or before January 20, 2005 at 5:00 p.m. During the course of a settlement conference on January 19, 2005, Plaintiff's counsel sought additional time to respond to discovery and the Court directed him to supplement responses to discovery on or before January 26, 2005, at 5:00 p.m. The Court asked counsel for the Plaintiff to prepare an appropriate form of order, however, as of the date of the filing of this order, counsel for Plaintiff has yet to submit a form of order reflecting that extension nor has he supplemented his answers to interrogatories as previously ordered. Plaintiff's refusal to provide discovery is in defiance of the order of the Court and has effectively prevented Defendant from preparing a defense. The Court finds no reason or excuse for Plaintiff's failure to comply with discovery orders. Therefore, Plaintiff is hereby prohibited from introducing evidence or testimony relative to damages. The Court reserves jurisdiction to enter a further order prohibiting Plaintiff from being able to introduce evidence and present testimony supporting her claims of liability. Further, the Court finds that an award of attorney's fee to Defendant is warranted under the circumstances and counsel for Defendant is instructed to prepare an attorney's fee affidavit and file it with the Court on or before March 7, 2005.
