This matter comes before the Court pursuant to the generally continued hearing on the Debtors' Fifth Omnibus Objection to Certain General Unsecured Claims (the "Objection") filed by the above-captioned debtors (the "Debtors"). The Court has reviewed the Objection and finds that (a) the Court has jurisdiction over this matter pursuant to 28 U.S.C. §§ 157 and 1334, (b) this is a core proceeding pursuant to 28 U.S.C. § 157(b)(2); and (c) notice of the Objection (and service of the proposed order) was sufficient under the circumstances. Wherefore, it appearing to the Court having determined that the legal and factual bases set forth in the Objection establish just cause for the relief herein granted; it is hereby
ORDERED as follows:
1. Capitalized terms not otherwise defined herein have the meanings given to them in the Objection. This Order affects only the claims identified herein and on Exhibits 1-2 to this Order.
2. The claims identified in Exhibit 1 (the "Allowed Claims") to this Order have been resolved in the manner identified in Exhibit 1 to the Order.
3. The claim identified in Exhibit 2 (the "Unresolved Claim") identifies the claim of a claimant, the objection to which has not been resolved yet. This Order shall not affect the Unresolved Claim. The Objection as it relates to the Unresolved Claim shall remain pending until further order of this Court.
4. Except to the extent expressly allowed herein, the Debtors maintain the right to object further to any and all claims, whether or not the subject of this Objection, on any grounds as allowed by applicable law.
The Clerk is directed to send a copy of this Order to the parties on the attached Service List.
