WILLIAM MOORE, District Judge
Before the Court is Plaintiff and Defendant United States' "Joint Motion to Distribute Funds Held Pursuant to Interpleader." (Doc. 12.) Plaintiff filed its Complaint for Interpleader on August 22, 2003 and paid into the Court registry $1,871.86. These funds had apparently been deposited by Defendant Austin Lamb, Inc. into an account maintained by Plaintiff. The funds were the subject of a tax dispute, and, therefore, Plaintiff feared being burdened with liability to each defendant. Though the United States answered Plaintiff's Complaint, Defendant Austin Lamb, Inc. did not. Plaintiff and the United States filed a Stipulation of Dismissal, and the Court dismissed this case with prejudice on August 9, 2004. However, the funds paid into the registry by Plaintiff remain on deposit with the Court.
In the instant motion, Plaintiff and the United States represent that they agree that these funds should be applied to Austin E. Lamb's tax debts. Consequently, they request that the Court disburse the funds to the United States. What the parties are essentially asking the Court to do is decide their interpleader case with no input from Defendant Austin Lamb, Inc. after they have already dismissed their case with prejudice. The Court does not have the authority to take such action. Accordingly, Plaintiff and the United States' motion that the money be paid to the United States is DENIED. The Clerk of the Court is DIRECTED to return all funds that Plaintiff deposited into the Court's registry, including any interest that may have accrued, to Plaintiff so that Plaintiff may handle the funds as it deems appropriate.
SO ORDERED.
