By Case Management Schedhg Order dated August 25, 2004, the corn set certain dates. When plaintiffs and their counsel failed to appear at a status conference on November 5, 2004, the court issued an order to show cause why the matter should not be dismissed, both for failure to appear and because plaintiffs had taken no action to pursue their lawsuit since September 17, 2001.
Plaintiffs blamed their failure to appear on "office error" and indicated their desire to proceed with the lawsuit. The court was satisfied with their representations and issued another order, stating in relevant part that "the matter will proceed in accordance with the August 25, 2004, Case Management Scheduling Order." Order After Plaintiffs' Response to Order to Show Cause (Nov. 15,2004).
Pursuant to that Order, dispositive motions, if any, were to be heard by June 2, 2005, and a settlement conference was set for Friday, June 10, 2005, at 9:00 a.m. No motions were filed and, once again, no party appeared for the settlement conference. Accordingly,
IT IS ORDERED that this matter be and hereby is dismissed, with prejudice, for failure to prosecute.
