THOMAS RUSSELL, District Judge
This matter is before the Court for screening, pursuant to 28 U.S.C. § 1915A. Plaintiff, Robert Charles Johnson, pro se, seeks compensatory and punitive damages against eighteen Defendants, in their official and individual capacities, in connection with injuries he sustained during his arrest. Plaintiff seeks relief under 42 U.S.C. § 1981, 1983, 1985(3), and 1988, as well as state law claims of conspiracy, assault, and negligence. For reasons set forth in a Memorandum Opinion entered this date,
IT IS HEREBY ORDERED that the Court IDENTIFIES, pursuant to § 1915A, a claim against Defendants, John Holbrook; Kenneth Rippy; Stan Jones; and James Grant, in their individual capacities, for the alleged use of excessive force during Plaintiff's arrest, described in the complaint as the Second Claim for Relief, subsections (a) and (b), and the Fourth Claim for Relief (§ 1988); the Court will exercise supplemental jurisdiction over the state-law claims of conspiracy and assault, described in the complaint as the Fifth and Sixth Claims for Relief;
IT IS FURTHER ORDERED that the official-capacity claims against Defendants, Holbrook, Grant, Mayfield, Yates, Hall, West, Tarrence, Swiney, Prince, Payton, Wolford, Curry, and McFarland, are DISMISSED for seeking relief against state-employed Defendants (officers of the Kentucky State Police and Tennessee Highway Patrol) who are immune from such relief, pursuant to § 1915A(b); IT IS FURTHER ORDERED that the First Claim of Relief, under § 1981, is DISMISSED for failure to state a claim on which relief may be granted, pursuant to § 1915A(b);
IT IS FURTHER ORDERED that the Second Claim of Relief, under § 1983, is DISMISSED to the extent it asserts a claim against the City of Franklin, Kentucky, (specifically subsection (g)), and to the extent it asserts a claim against Defendants Rippy and Jones, in their official capacities, for failure to state a claim of municipal liability under § 1983 upon which relief may be granted, pursuant to § 1915A(b); On this basis, the Court directs the Clerk to terminate as a party to this action the City of Franklin, Kentucky;
IT IS FURTHER ORDERED that the Second Claim for Relief, under § 1983, is DISMISSED to the extent it asserts a due process claim, (specifically subsections (c) and (f)), for failure to state a claim on which relief may be granted, pursuant to § 1915A(b); On this basis, the Court directs the Clerk to terminate as parties to this action all individual officer Defendants, except Defendants Rippy, Holbrook, Jones, and Grant;
IT IS FURTHER ORDERED that the Second Claim for Relief, under § 1983, to the extent it asserts a conspiracy claim, (specifically subsections (d) and (e)), and the Third Claim for Relief, under § 1985(3), are DISMISSED for failure to state a claim on which relief may be granted, pursuant to § 1915A(b);
IT IS FURTHER ORDERED that the Seventh Claim for Relief, common law negligence, is DISMISSED for failure to state a claim upon which relief may be granted with respect to the City of Franklin; and for seeking relief against a defendant who is immune from such relief, with respect to the Commonwealth of Kentucky, pursuant to § 1915A(b);
IT IS FURTHER ORDERED that Plaintiff's motion to appoint counsel is DENIED.
This is a non-final, non-appealable order.
