ORDER GRANTING DISBURSING AGENT'S OBJECTION TO PROOF OF CLAIM FILED BY GARY NORTON AND REQUEST FOR RULE 9011 SANCTIONS [Docket No. 5293]

JEFF BOHM, Bankruptcy Judge

CAME ON for consideration and hearing on July 27, 2005 the Disbursing Agent's Objection to Proof of Claim Filed by Gary Norton and Request for Rule 9011 Sanctions filed by John Hale (Docket No. 5293) (the "Objection"). The Court, having considered the pleadings and the evidence offered at the hearing, and after hearing the arguments of Counsel, finds that the Objection has been properly served pursuant to the Federal Rules of Bankruptcy Procedure and Local Rules of Bankruptcy Procedure and that the Objection is well taken and should be granted. Accordingly

IT IS, THEREFORE, ORDERED, ADJUDGED, and DECREED, that the Objection is GRANTED except as to the request for the Rule 9011 sanctions, which was withdrawn without prejudice; and it is further

ORDERED that the proof of claim filed on May 18, 2005, identified by BSI as Claim No. 5169 filed against Encompass Services Corporation and found on this Court's Claim Register for Case No. 02-43582 as Claim No. 593, is hereby disallowed in its entirety. It is further

ORDERED that all findings of fact and conclusions of law made by this Court in accordance with Federal Rule of Bankruptcy Procedure 7052 during the July 27, 2005 hearing on this matter are hereby incorporated by reference for any and all purposes.
