In re: Charles Edward Kean Cynthia Diane Kean, Chapter 7 Debtors.

AGREED ORDER ON MOTION FOR RELIEF FROM STAY

JOHN HOFFMAN, Bankruptcy Judge

This matter is before the Court upon the Motion for Relief From Stay of Worthington Park Condominium Association ("WPCA"), the Memorandum in Opposition filed by Susan L. Rhiel, Trustee and the Order Setting Consolidated Preliminary and Final Hearing dated August 3, 2005. WPCA is seeking relief from the automatic stay with reference to property known as 7884 Barkwood Drive, Worthington, Ohio 43011 (the "Real Estate") for outstanding condominium fees and charges which are due and owing but for which no lien has yet been filed. On August 4, 2005, the Trustee filed a Motion to Sell the Real Estate free and clear of any and all liens, claims, and encumbrances due to issues that exist regarding the recording of the first and second mortgages against the Real Estate (the "Sale Motion"). The Trustee intends to sell the Real Estate and hold the proceeds pending further order of the Court or agreement of the parties.

The Trustee recognizes that WPCA may have an interest in the proceeds generated from the sale of the Real Estate, which interest, if any, shall attach pursuant to the terms and conditions of the Sale Motion. The parties accordingly agree to hold WPCA's Motion for Relief from Stay in abeyance pending a determination of the Sale Motion.

IT IS SO ORDERED.
