ORDER ADJOURNING THE HEARING ON THE THIRD OMNIBUS OBJECTION ONLY AS TO CLAIMS FILED BY A J GREENE d/b/a A J GREENE ASSOCIATES (CLAIM # 852) AND SAMMIE L. GREEN (CLAIM # 5796)

This matter having come before the Court on the objection, dated August 25, 2005 (the "Third Omnibus Objection"), wherein Interstate Bakeries Corporation ("Interstate Bakeries" or the "Company") and sevenfn1 of its subsidiaries and affiliates, debtors and debtors-in-possession in the above-captioned cases (collectively, the "Debtors"), filed an objection, pursuant to 11 U.S.C. §§ 102, 105 and 502, Fed.R.Bankr.P. 3003 and 3007 and Local Rules 3003-1 and 3007-1 expunging certain claims set forth in the Third Omnibus Objection, (i) it has jurisdiction over the matters raised in the Third Omnibus Objection pursuant to 28 U.S.C. §§ 157 and 1334; (ii) this is a core proceeding pursuant to 28 U.S.C. § 157(b)(2); (iii) proper and adequate notice of the Third Omnibus Objection and the hearing thereon has been given and that no other or further notice is necessary; and (iv) upon the record herein after due deliberation thereon, the Court finds that the hearing on the claim objections as to A J Greene d/b/a A J Greene Associates (Claim No. 852) and Sammie L.Green (Claim No. 5796) should be adjourned to November 9, 2005 at 2:00 p.m. per agreement between the parties.
Unless otherwise defined, capitalized terms used herein shall have the meanings ascribed to them in the Objection.
IT IS HEREBY ORDERED, ADJUDGED AND DECREED THAT:
1. 1. The hearing on the claim objections set forth in the Third Omnibus Objection as to the claim filed by A J Greene d/b/a A J Greene Associates (Claim No. 852) and Sammie L. Green (Claim No. 5796) be, and hereby is Adjourned to November 9, 2005 at 2:00 p.m.
2. This Order is without prejudice to the Debtors' right to object to any other claims in these Chapter 11 cases or to further object to claims objected to herein.
3. This Court shall retain jurisdiction over the Debtors and the claimants whose Claims are subject to the Third Omnibus Objection with respect to any matters related to or arising from implementation of this Order.
