BARRY SCHERMER, Bankruptcy Judge
Movant, Eustace W. Henry ("Henry"), by counsel, and Respondent, Falcon Products, Inc. ("Falcon"), by counsel, hereby stipulate and agree to relief from the automatic stay of 11 U.S.C. § 362(a) on the following terms, and recommend that the Court enter the same as its order on Movant's Motion to Lift Stay previously filed in this case, as follows:
1. Prior to the petition for relief in this case, Movant filed a civil action to recover damages for personal injuries against Falcon and others in the District Court of Clark County, Nevada, case no. A487015 (the "Personal Injury Action"). The Personal Injury Action was stayed by this Chapter 11 proceeding.
1. Good cause has been shown to grant limited relief from the automatic stay as set forth herein.
2. If Movant obtains judgment against Debtor and/or any entity that is a co-Debtor in a case jointly administered in this Court under case no. 05-41108-399 (hereafter "Falcon Debtors"), Movant will seek recovery of such judgment solely against insurers of liability of Falcon Debtors. Movant agrees that he will forthwith withdraw his proof(s) of claim in the cases of Falcon Debtors and shall not file any amendments, substitutions, or replacements thereof. Movant further agrees that Movant will not seek in any other manner to receive a distribution of money (with the exception of payments or proceeds from insurers described above) from the estates of Falcon Debtors or from any successors of the estates but in any and all events shall be limited, in respect to any judgment against Falcon Debtors, to recovery from insurers of Falcon Debtors.
The "Falcon Debtors" consist of Falcon Products, Inc., Epic Furniture Group, Inc., Falcon Holdings, Inc., The Falcon Companies International, Inc., Sellers Josephson, Inc., Howe Furniture Corporation, Shelby Williams Industries, Inc., Madison Furniture Industries, Inc., and Sellers Johnson Industries, Inc.
3. Nothing in this Agreed Order shall be deemed to affect either the Personal Injury Action against parties that are not Falcon Debtors or any other claims by Eustace W. Henry against parties that are not Falcon Debtors.
NOW, THEREFORE, the Court adopts all facts stated in the foregoing paragraphs as its findings on the Motion of Eustace W. Henry for Relief from the Automatic Stay, and on the basis thereof,
IT IS ORDERED that the automatic stay is modified to permit Eustace W. Henry to liquidate his claim for personal injuries in the Personal Injury Action described above; and
IT IS FURTHER ORDERED that this relief shall extend to, and shall be deemed to be limited relief from, any discharge injunction that is entered by reason of confirmation of a plan of reorganization of Falcon Debtors or any one or more of them in these Chapter 11 proceedings; and
IT IS FURTHER ORDERED that Eustace W. Henry shall forthwith withdraw his proof(s) of claim in these proceedings and shall not file any amendments, substitutions, or replacements thereof; and shall not receive a distribution of money or other consideration (with the exception of payments or proceeds from insurers described above) from the Falcon Debtors or from any of their successors.
