JAMES MARLAR, Bankruptcy Judge
The motion to retain conservator having come before the court on November 30, 2005, and the court having considered all of the matters before it, and for the reasons stated on the record, finds good cause to:
1. Grant the State's motion to retain the conservator appointed by the Arizona Superior Court, subject to reconsideration for cause by any party in interest, and without prejudice to revisit this order at any time;
2. Require the conservator, should be expect payment from the estate, to file an appropriate application with the court;
3. Order the United States Trustee to appoint an independent trustee in this case, so that a completely impartial and disinterested person, under bankruptcy law, may take control of the assets of this estate and administer the estate for the benefit of creditors and other interested parties. The court exercises its power under § 105 to do so. See In re Bibo, 76 F.3d 256 (9th Cir. 1996); § 1104;
4. Terminate the exclusivity period;
5. Determine, from the schedules on file in this case, that this is a "small business case" under § 101(51)(c)(I);
6. Order any interested party who desires to do so to file a plan and disclosure statement no later than January 7, 2006; and
7. Set a confirmation hearing on any such plan(s) for February 16 and 17, 2006.
