This matter is before the Court upon the Motion for Leave to Respond to Defendant's Reply to Plaintiff's Memorandum in Opposition to Defendant's Motion for Summary Judgment. See (Dkt. # 25).
The Court held a Case Management Conference on May 8, 2006. Attorneys Angela J. Mikulka and Thomas L. Mikulka appeared on behalf of the Plaintiff, while Attorney Nicholas W. Ferrigno appeared on behalf of the Defendant. As a result of the discussions held during the CMC, the Court ordered that the matter be placed on the Expedited Track. The Court further ordered that the parties address the statute of limitations defense.
The Defendant filed its motion for summary judgment on June 9, 2006 and the Plaintiff filed its Memorandum in Opposition on July 10, 2006. The administrative record was filed, under seal, on July 24, 2006.
The Defendant filed its Reply on August 3, 2006. The Defendant thereafter contacted the Court and advised that an error had occurred while filing the Reply in an electronic format. The Court instructed the party the re-file the Reply. Meanwhile, the Plaintiff filed the present motion.
Accordingly, the Court hereby orders that the Defendant shall file a corrected version of its Reply on or before August 9, 2006. the Court further orders that the Plaintiff's motion for leave is GRANTED and she shall file a Sur-Reply on or before August 14, 2006.
The status conference scheduled for August 11, 2006 at 10:30 a.m. is CANCELLED.
