Upon consideration of the objection of Gerald M. O'Donnell, chapter 13 trustee, to confirmation of the plan filed by the debtor on August 12, 2006, and for the reasons stated in the memorandum opinion filed with this order, it is
ORDERED:
1. The objection is sustained, and confirmation of the plan filed by the debtor on August 12, 2006, is denied, with leave to the debtor to file a modified plan within 20 days of the entry of this order.
2. Unless, within 20 days of the entry of this order, the debtor files a modified plan, a notice of conversion to chapter 7, or a motion to convert to chapter 11, or, within 10 days of the entry of this order files a motion for a new trial, a motion to alter or amend this order, a notice of appeal, or a motion to extend the time for appeal, the clerk shall enter an order dismissing this case without further notice or hearing under the authority of Local Bankruptcy Rule 3015-2(H)(3).
3. The clerk will mail a copy of the memorandum opinion and this order, or give electronic notice of their entry, to the parties listed below.
