JOHN DALIS, Chief Judge
The Motion for Relief from Stay filed on September 21, 2006, by Mazda America Credit, having come before the Court for hearing on November 14, 2006, and upon presentation of counsel for the Movant, the Debtor, and the Trustee, the Court finds the following:
FACTS
Debtor filed this Chapter 13 case on May 1, 2006. Debtor's Plan proposed pre-confirmation adequate protection payments to Movant in the amount of $50.00 and monthly payments following confirmation in the amount of $121.42 to pay Movant's secured claim in full, all to be disbursed from monthly payments made to the Chapter 13 Trustee. The Plan further provided for payments by Debtor to the Trustee in the amount of $240.00 per month, to be made by a salary deduction from Debtor's employer.
The initial payment to the Trustee was received on July 11, 2006, in the amount of $443.04. The next payment received by the Trustee, in September 2006, was in the amount of $498.42, followed by a further payment in October 2006 in the amount of $221.52. The total of payments made to the Trustee as of the hearing date was $1,162.98.
Mazda, the holder of a claim in the amount of $3,893.48 secured by a perfected security interest in a 1999 Chevrolet Suburban ("Vehicle"), filed its proof of claim on or about May 10, 2006. Thereafter, Mazda filed a motion seeking relief from stay in order to pursue its remedies against the Vehicle. The basis for Mazda's motion is that it has received only $29.53 in payment of its claim in this case, despite the fact that Debtor's Plan was confirmed on July 11, 2006. Including the payment of $29.53 to Mazda, the Chapter 13 Trustee's office has made the following payments from the funds received from Debtor: Clerk, U.S. Bankruptcy Court (filing fee) $235.00 Clerk, U.S. Bankrutpcy Court (admin fee) 39.00 Trustee's percentage 55.40 Attorney for Debtor 800.00 Movant (interest) 29.53 $1,158.93
CONCLUSIONS
As of the hearing date, Debtor is behind in payments to the Trustee; provided that the Debtor remains employed and salary deductions continue, the Court acknowledges that the arrearage is merely a matter of a delay in remittal from Debtor's employer. The Court does not at this time find such arrearage to be grounds for granting the relief sought by Movant.
Where, as here, the provisions of Debtor's confirmed Plan require the Trustee to pay a designated monthly payment to secured creditors, as scheduled in the confirmed Plan, such specific monthly payment must be paid ahead of other non-specific plan obligations, including court costs, attorneys fees, and claims of unsecured creditors. From the funds received by the Trustee, the Trustee first should pay the pre-confirmation adequate protection payments provided for in the Plan; and second, post-confirmation, the designated scheduled monthly payments to the secured creditor. Remaining funds would then be disbursed to administrative claimants and other creditors in the priority established by the Bankruptcy Code.
In this case, upon receipt of the initial payment on the date of plan confirmation, the Trustee should have disbursed to Mazda the sum of $100.00 for pre-confirmation adequate protection for two months and the further sum of $121.42 for the initial post-confirmation monthly payment due Mazda. The balance of the initial payment to the Trustsee would have been applied in the usual order of paying other plan obligations. Inasmuch as the second payment to the Trustee was not made until September 2006, the Trustee should have made from such payment the designated post-confirmation payments due Mazda for August 2006 and September 2006 in the combined amount of $242.84.
It is therefore ORDERED that the relief sought by Movant is denied, provided the Trustee shall cure as soon as possible the arrears in payments due Movant, both as set forth above and as may hereafter come due, utilizing funds on hand and all funds received from Debtor or from Debtor's employer.
