{¶ 1} On February 12, 2007, plaintiff, George G. Fliotsos, filed a complaint but failed to name a defendant. On February 15, 2007, this court issued a notice to plaintiff to file a corrected complaint by naming a state entity as defendant. On February 23, 2007, plaintiff filed a corrected complaint naming Mahoning County Engineers Road Department as defendant.
{¶ 2} R.C. 2743.02(E) in pertinent part states:
{¶ 3} "The only defendant in original actions in the court of claims is the state."
{¶ 4} The Mahoning County Engineers is not a state entity. Accordingly, plaintiffs case is dismissed. Upon review, the court finds plaintiff has failed to name a state entity as defendant as is required by R.C. 2743.02(E). Accordingly, plaintiffs case is DISMISSED without prejudice. The court shall absorb the court costs of this case.
