G. TIDWELL, District Judge
The above-styled matter is presently before the court on plaintiff Kennedy Farms, Inc.'s renewed motion for default judgment against defendant Kilburnie Pastoral Company Proprietary Limited [docket no. 6].
On January 23, 2007, plaintiff filed the instant action against defendant alleging that defendant executed and delivered to plaintiff three loans, two in the principal amount of $150,000.00 and one in the principal amount of $300,000.00, and that defendant then failed to pay plaintiff when the loans became due. Plaintiff seeks outstanding principal and interest on the loans, along with attorney's fees. Defendant, an Australian proprietary company, acknowledged service of plaintiff's complaint on February 12, 2007. Defendant, however, did not file an answer or other response to plaintiff's complaint. The Clerk of Court entered Default as to defendant on March 12, 2007.
Plaintiff filed a motion for default judgment on March 9, 2007. The court denied plaintiff's motion without prejudice on April 11, 2007, due to inconsistencies in the amounts plaintiff alleged were owed by defendant in plaintiff's complaint and in its motion for default judgment. The court directed plaintiff's counsel to explain and justify what he relied upon for the sums requested and to provide the court with an explanation as to how the interest on the loans was calculated.
On April 23, 2007, plaintiff filed its renewed motion for default judgment. Included with the motion is an explanation for the discrepancies in the amounts plaintiff contends it is entitled to from defendant in plaintiff's complaint and its original motion for default judgment. Plaintiff also included a spreadsheet explaining to the court how the interest on the loans was calculated. As of the date of this order, defendant has not filed a response to plaintiff's motion for default judgment.
Plaintiff's motion states that it is entitled to $600,000.00, which represents the principal amount of the three loans executed by defendant. Plaintiff further requests $420,671.04 in interest as of April 20, 2007, which will continue to accrue at a rate of $116.64 per diem until the entry of judgment. Plaintiff also requests attorney's fees in the amount of $52,654.25 through April 20, 2007, post-judgment interest pursuant to 28 U.S.C. § 1961, and all costs. The court finds that plaintiff has established its entitlement by sufficient evidence. Therefore, plaintiff's renewed motion for default judgment [docket no. 6] is hereby GRANTED.
The Clerk of Court is hereby DIRECTED to enter judgment in favor of plaintiff and against defendant in the amount of $600,000.00 in principal, $420,671.04 in interest, which continues to accrue at the rate of $116.64 per diem until the entry of judgment, $52,654.25 in attorney's fees, post-judgment interest, and all costs.
