IN RE LESTER JON RUSTON, Relator.

MEMORANDUM OPINION

Opinion By Justice BRIDGES.

In his petition for writ of mandamus, relator complains that his civil case should be transferred from Collin County to Dallas County. The facts and issues are well known to the parties, so we need not recount them herein. Based on the record before us, we conclude relator has failed to show the trial court clearly abused its discretion. See Tex. R. App. P. 52.8(a); Walker v. Packer, 827 S.W.2d 833, 839-44 (Tex. 1992) (orig. proceeding). Accordingly, we DENY relator's petition for writ of mandamus. See Tex. R. App. P. 52.3.

This petition was filed with the Court on June 8, 2007. We note relator was declared a vexatious litigant in trial court cause number 366-141-07 in the 366th Judicial District Court on June 14, 2007.
