THOMAS TUCKER, Bankruptcy Judge
This case is before the Court on "Debtor's "Application to Impose the Automatic Stay," filed on December 27, 2007 (Docket # 8). The Court must deny the motion because it is unnecessary. Under 11 U.S.C. § 362(c)(4)(A)(i):
if a single or joint case is filed by or against a debtor who is an individual under this title, and if 2 or more single or joint cases of the debtor were pending within the previous year but were dismissed, other than a case refiled under section 707(b), the stay under subsection (a) shall not go into effect upon the filing of the later case.
This provision does not apply to this case because Debtor did not have two cases "pending" within the 1-year period before filing this case that were "dismissed." Rather, Debtor had no such cases.
On December 21, 2007, Debtor filed a voluntary petition for relief under Chapter 13, initiating this case. This is Debtor's third bankruptcy case since April 2004; these are discussed below:
Case number one: Debtor filed a Chapter 7 case on January 23, 2004 (Case No. 04-41863). That case was not dismissed. Rather, Debtor received a discharge on May 12, 2004. The case was closed on August 19, 2004. That case was neither "pending" within the 1-year period before filing this case nor "dismissed." Case number two: Debtor filed a Chapter 13 case on April 12, 2006 (Case No. 06-44550). Debtor voluntarily dismissed that case on December 6, 2006, the date the dismissal order was entered. The Chapter 13 Trustee filed her final report on April 16, 2007. The Clerk closed the case on May 17, 2007.
This second case (No. 06-44550) was no longer "pending," within the meaning of §§ 362(c)(3) and 362(c)(4)(A)(i), after December 6, 2006, the date on which the Court entered its dismissal order. See, e.g., Black's Law Dictionary 1154 (7th ed. 1999) ("Pending" means: "Remaining undecided; awaiting decision a pending case"). And it was the order dismissing the case that terminated the automatic stay in that case, not the later acts of the Chapter 13 Trustee filing her final report or the Clerk's closing the case. See 11 U.S.C. § 362(c)(2)(B). Any delay by the Chapter 13 Trustee in filing her final report, or by the Clerk in closing the case, therefore, did not keep the case "pending" in the sense in which that word is used in §§ 362(c)(3) and 362(c)(4)(A)(i).
Because Debtor did not have any prior bankruptcy cases that were "pending" and "dismissed" within one year before the filing of this case, the automatic stay went into effect upon the filing of this case, and the automatic stay will not terminate under § 362(c)(3)(A). Debtor's motion therefore is unnecessary. Accordingly,
IT IS ORDERED that "Debtor's "Application to Impose the Automatic Stay" (Docket # 8) is DENIED, as unnecessary.
