ORDER
Upon consideration of the motion to dismiss appeal, or, in the alternative, to transfer appeal to the Ninth Circuit, and the opposition thereto, it is
ORDERED that the motion to transfer be granted. Appellant does not contest that the proper venue for appellate review of the Tax Court's dismissal of her petition is in the United States Court of Appeals for the circuit encompassing her legal residence at the time her Tax Court petition was filed. See I.R.C. § 7482(b)(1)(A). Appellant offers no evidence to dispute the fact that her legal residence at the time she filed her petition was in Montana, which is in the Ninth Circuit. See 28 U.S.C. § 41. Therefore, this appeal, along with the pending motion to dismiss, will be transferred to the Ninth Circuit. See Alexander v. Comm'r, 825 F.2d 499, 502 (D.C. Cir. 1987) (per curiam).
Pursuant to D.C. Circuit Rule 36, this disposition will not be published. The Clerk is directed to transmit the original file and a certified copy of this order to the United States Court of Appeals for the Ninth Circuit.
