IN THE MATTER OF B.J., A MINOR.

MEMORANDUM OPINION

PER CURIAM.

By letter dated October 28, 2009, the Court notified appellant that his brief is overdue. We directed appellant to file, within ten days of the date of the letter, both his brief and a motion to extend time to file his brief. We further warned appellant that if he failed to comply, we would dismiss the appeal without further notice. See Tex. R. App. P. 38.8(a). To date, appellant has neither filed his brief nor otherwise communicated with the Court regarding his appeal. Accordingly, we dismiss the appeal. See Tex. R. App. P. 38.8(a), 42.3(c).
