STATE OF TENNESSEE v. EDWARD JEROME HARBISON.

ORDER

PER CURIAM.

On July 26, 2010, the State filed a Motion to Re-Set Execution Date for Edward Jerome Harbison. The motion stated that the United States District Court for the Middle District of Tennessee has vacated its injunction of Mr. Harbison's execution and that there are now no legal impediments to his lawful execution.

On July 29, 2010, Edward Jerome Harbison filed an Unopposed Motion for Extension of Time to Respond to State's Motion to Re-Set Execution Date because of counsel's active and heavy caseload, including her role as lead counsel on several capital cases and a trial scheduled for federal court at the end of August. The State does not object to the extension.

Upon due consideration of the Motion for Extension of Time, it is hereby ORDERED that the Motion is GRANTED. Edward Jerome Harbison shall have up to and including Tuesday, September 7, 2010, to file a response to the State's Motion to Re-Set Execution Date.
