Department of Public Utilities. Public Utilities, Fuel charges, Rate setting. Gas Company.
Discussion of the standard of review applicable to an agency decision that raises no constitutional questions. [811-812]
The Department of Public Utilities (department) erred as a matter of law in determining that a municipal gas and electric company was required to seek preapproval of its gas purchasing plans, which were intended to stabilize gas supply prices through the use of forward contracts, where the plans incorporated only traditional risk management techniques that previously had never been subject to the department's preapproval. [812-814] The Department of Public Utilities (department) erred as a matter of law in determining that a municipal gas and electric company acted imprudently when executing two sets of its gas purchasing plans, where the findings of imprudence in those instances were not based on substantial evidence [814-815]; however, with respect to a third gas purchase, substantial evidence amply supported the department's finding of imprudence [815]; therefore, this court recalculated the remedy for that imprudent purchase and remanded the matter to the department for further consideration of a factual issue [815-816].
