(Syllabus.)
1. Intoxicating Liquors — Statutory Provision as to Search of Private Residence. Tit. 37 O. S. 1941 § 88 provides: "No warrant shall be issued to search a private residence, occupied as such, unless it, or some part of it, is used as a store, shop, hotel, boarding house, or place for storage, or unless such residence is a place of public resort."
2. Same — Drinking from Bottle in One's Own Home not a Misdemeanor. It is not a misdemeanor for one to take a drink from a bottle in his own home; and the fact that officers, looking through a window saw him do so, does not constitute the commission of a misdemeanor in the presence of officers which would justify search of defendant's home without a warrant.
3. Searches and Seizures — Expression "No, Help Yourself", Construed as Not Constituting Waiver.
